Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) form a binding agreement between you and JDS Solutions LLC, doing business as (d/b/a) Profytabl App (“we”, “our”, “us”), governing your access to and use of the Profytabl App platform, websites, and related services (collectively, the “Service”). By creating an account, connecting a store, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Profytabl is a profit analytics platform for TikTok Shop sellers. It connects to your TikTok Shop through TikTok’s official Partner API to surface profit analytics and business insights, including gross profit, net profit, margin analysis, and performance metrics at the SKU and order level. The Service is provided for informational and analytical purposes to help you understand your store’s performance.

3. Eligibility

You must be at least 18 years of age and capable of forming a binding contract to use the Service. By using the Service you represent and warrant that you meet these requirements and that you are authorized to act on behalf of the business or store you connect.

4. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information, to keep it current, and to notify us promptly of any unauthorized use of your account. We are not liable for any loss arising from your failure to safeguard your credentials.

5. Acceptable Use

You agree not to:

• Use the Service in violation of any applicable law or third-party rights
• Access, scrape, or use the Service or its data other than through the interfaces we provide
• Attempt to gain unauthorized access to the Service, other accounts, or our systems
• Interfere with, disrupt, or impose an unreasonable load on the Service or its infrastructure
• Reverse engineer, copy, resell, or create derivative works from the Service except as permitted by law

6. TikTok Shop Integration

Profytabl connects to your TikTok Shop using an official Partner API authorization that you grant. We access only the data necessary to provide the Service. Profytabl never posts on your behalf and never sees or stores your TikTok password. Your use of TikTok Shop remains subject to TikTok’s own terms and policies, and you are responsible for maintaining your TikTok Shop account in good standing.

7. Fees and Subscription

Some features of the Service may require a paid subscription. Applicable fees, billing cycles, and any free-trial terms will be presented to you at the time of purchase. Unless otherwise stated, fees are non-refundable except where required by applicable law. We may change pricing on a prospective basis with reasonable notice; continued use after a price change takes effect constitutes acceptance.

8. Intellectual Property

The Service, including its software, design, and content (excluding your data), is owned by JDS Solutions LLC and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes in accordance with these Terms. You retain all rights to the data you provide or that we sync on your behalf.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your information. You may request deletion of your data at any time via our Data Deletion page.

10. Estimates and No Professional Advice

Profit, margin, fee, and other figures presented by the Service are estimates derived from the data available through the TikTok Shop API and the cost inputs you provide. They may differ from official settlement statements and should not be relied upon as accounting, tax, legal, or financial advice. You are responsible for verifying figures against your official records and for consulting a qualified professional where appropriate.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that the data displayed will always be accurate or complete.

12. Limitation of Liability

To the maximum extent permitted by law, JDS Solutions LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of the amount you paid us in the twelve months preceding the claim or one hundred U.S. dollars (US$100).

13. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if continued provision of the Service is no longer commercially reasonable. Upon termination, your right to use the Service ceases and your data is handled as described in our Privacy Policy and Data Deletion page.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or applicable law. We will notify you of material changes via email and/or in-app notification before they take effect. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Arkansas, United States, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Arkansas for any dispute arising out of or relating to these Terms or the Service.
